Savvy™ Installment Payment Plan Policy

 EFFECTIVE DATE: 9/20/2024

Savvy Biz Coach™ ("Company," "we," "us," or "our") offers an Installment Payment Plan ("Payment Plan") to provide flexible payment options for clients ("Client," "you," or "your") purchasing online courses and business coaching services. This policy outlines the terms and conditions for clients choosing to pay through installments.

By enrolling in the Payment Plan, you acknowledge that you have read, understood, and agree to this Installment Payment Plan Policy.

 ELIGIBILITY FOR INSTALLMENT PAYMENT PLAN

The Payment Plan is available for select online courses, bundles, and business coaching services, as indicated at the time of purchase. To qualify for the Payment Plan, you must:

  • Be at least 18 years old or the legal age of majority in your jurisdiction.

  • Provide accurate payment information (e.g., valid credit or debit card) at the time of purchase.

  • Agree to pay the full amount in installments according to the plan specified at checkout.

 INSTALLMENT SCHEDULE AND STRUCTURE

  • Payment Schedule: The total price of the course or service is divided into equal installments, payable at regular intervals (e.g., monthly), as specified at the time of purchase and in the product’s description.

  • Initial Payment: The first installment is due at the time of purchase, and subsequent payments will be automatically billed according to the payment schedule provided during checkout.

  • Duration of Plan: The number of installments and payment schedule will be outlined before completing your purchase.

  • Non-Refundable Installments: Payments made under the Payment Plan are non-refundable except as outline in our Refund, Cancellation & Rescheduling Policy. Once you have accessed an online course, bundle or coaching service, and the first payment has been made, you are obligated to complete all remaining payments.

 AUTOMATIC PAYMENTS

By enrolling in the Payment Plan, you authorize Savvy Biz Coach™ to automatically charge the payment method you provide for each installment on the scheduled due date. If your payment method changes, it is your responsibility to update the information before the next installment is due.

 LATE OR MISSED PAYMENTS

  • Declined Payments: If a payment is declined or cannot be processed, you will receive an email notification, and we will attempt to process the payment again within a grace period of 5 business days.

  • Access Revocation: If payment is not successfully made within the grace period of 5 business days, you will lose access to the online course, bundle or coaching service until the balance is paid.

  • Account Delinquency:  If your account is delinquent more than 10 business days (including the 5-day grace period), Savvy Biz Coach™ will terminate your access to the course, bundle, or coaching services and reserves the right to send the account to collections. You will be responsible for additional fees or costs related to collections. No refunds will be issued for prior payments.

EARLY PAYMENT OPTION

You may choose to pay off the remaining balance of the Payment Plan at any time without penalty. To arrange for early payment, please contact us by submitting a Help Request, and we will assist you in completing the transaction.

 INTELLECTUAL PROPERTY AND ACCESS

All course materials, content, and resources provided by Savvy Biz Coach™ remain the property of the Company. Your access to these materials is contingent upon timely and full payment of all installments. Failure to complete payments will result in suspension or termination of access to the course or services as outlined in this policy, and Savvy Biz Coach™ reserves the right to take appropriate action to collect the outstanding balance.

 MODIFICATION OF THE PAYMENT PLAN

Savvy Biz Coach™ reserves the right to modify or discontinue the Payment Plan at any time, but any changes will not affect clients currently enrolled in an existing plan. The terms in effect at the time of your enrollment will continue to apply.

GOVERNING LAW

These policy and any disputes related to it shall be governed by and construed in accordance with the laws of the District of Columbia without regard to its conflict of law principles. Any legal actions or proceedings arising out of or related to these Terms shall be brought exclusively in the federal courts in the District of Columbia, and you consent to the jurisdiction and venue of such courts.

In the event of any dispute, claim, or controversy arising out of or relating to this policy, the services provided by Savvy Biz Coach™, or the relationship between the you and the Company, the parties agree to first attempt to resolve the dispute through good faith negotiation. If such efforts fail to resolve the dispute within thirty (30) days, the parties agree to submit the matter to mediation before a mutually agreed upon neutral mediator located in the District of Columbia with expertise in online coaching and business education.

The mediation shall be conducted in accordance with the mediation rules of the American Arbitration Association or another recognized mediation service provider agreed upon by the parties. Each party shall bear its own costs and expenses associated with the mediation, but the costs of the mediator shall be shared equally by both parties. The mediation will be conducted in English; each party is responsible for the costs of their own interpretive language services.

If mediation does not result in a resolution of the dispute, either party may pursue further legal remedies as permitted by this policy or by applicable law. Mediation is a condition precedent to the initiation of any legal proceedings, unless seeking injunctive relief to protect intellectual property rights or prevent irreparable harm.

Nothing in this clause shall prevent either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction in the District of Columbia as necessary to protect its rights pending the outcome of mediation.

CHANGES TO THIS POLICY

We may update this policy from time to time to reflect changes in our practices or legal requirements. We will notify you of any significant changes by posting the updated policy on our website and updating the "Effective Date" at the top of this policy.

HEADINGS & SEVERABILITY

The headings used in this policy are for convenience and reference purposes only and shall not affect the interpretation or construction of any provisions of this Installment Payment Plan Policy.

If any provision of this policy is held to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be deemed modified so as to be enforceable to the fullest extent permitted by law while maintaining the original intent of the parties, or, if such modification is not possible, the provision shall be deemed severed from this Installment Payment Plan Policy.
